ITC judges make scheduling decisions in cases involving Apple, HTC, Samsung, Microsoft, Google

Three scheduling decisions in investigations that I follow were made by ITC judges in recent days:

  1. Judge Shaw set a schedule today for the investigation of Apple's enforcement complaint against HTC. He scheduled the evidentiary hearing (trial) for December 19-20, 2012; his initial determination for March 8, 2013; and the final Commission decision for July 8, 2013 (12 months after the institution of the enforcement proceeding).

  2. Judge Pender pushed back the target date for the investigation of Apple's complaint against Samsung by two weeks from February 5, 2013 to February 19, 2013. Accordingly, his initial determination will be due on October 19 (not 5), 2012. The reason is just that he has a couple of key events coming up in other cases, including an Apple v. HTC trial (on Apple's second ITC complaint against HTC) in September.

  3. On a tentative basis, Judge Shaw has scheduled a second trial in the investigation of Google subsidiary Motorola Mobility's complaint against the Xbox (focused on the issues to be addressed on remand, which favor Microsoft) for November 14 and 15, 2012. On Friday I reported on a recent Microsoft filing according to which Google "committed to license two of the patents at issue to Microsoft as a result of its participation in the MPEG-LA AVC [H.264] patent pool".
